Powers and Functions of the Nagaland Lokayukta
The Lokayukta and Upa-Lokayukta of the Nagaland Lokayukta are appointed by the State Government to represent the interest of the public.
Some of the powers and functions of the Nagaland Lokayukta are:
1. To investigate and inquire into complaints involving offences as provided under the following acts:
• Prevention of Corruption Act, 1988.
• Whistle Blowers Protection Act, 2011.
2. The Lokayukta or Upa-Lokayukta may investigate into any complaint involving a grievance or allegation that is made by:
• Any citizen.
• Referred by the State Government.
• Suo moto, without any complaint.
3. For the purpose of any investigation, including preliminary inquiry, the Lokayukta or Upa-Lokayukta shall have all the powers of a civil court while trying a suit under the Code of Civil Procedure, 1908, in respect of some matters as provided in Section 14(2) of the Act.
4. Any proceeding before the Lokayukta or Upa-Lokayukta is deemed to be a judicial proceeding within the meaning of Section 193 and 228 of the Indian Penal Code, 1860.
5. The Lokayukta or Upa-Lokayukta is deemed to be a court within the meaning of the Contempt of Courts Act, 1971 and have the same judicial powers and authority of a High Court.
